By accessing or using Mobcraft Storage ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting.

2. Description of Service

Mobcraft Storage is a cloud storage service that allows users to upload, store, manage, and retrieve files. The Service utilizes secure cloud infrastructure for file storage and provides API access for integration with third-party applications.

3. Account Registration

3.1 Eligibility

You must be at least 13 years old to use the Service. By registering, you represent that you meet this age requirement.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials, including your API keys. You agree to notify us immediately of any unauthorized access to your account.

3.3 Account Information

You agree to provide accurate, current, and complete information during registration and to update such information as necessary.

4. Acceptable Use

You agree NOT to use the Service to:

• Upload, store, or distribute illegal content
• Infringe on intellectual property rights of others
• Distribute malware, viruses, or harmful code
• Store or distribute child sexual abuse material (CSAM)
• Harass, threaten, or harm others
• Engage in spam or phishing activities
• Attempt to gain unauthorized access to our systems
• Circumvent storage limits or abuse the Service
• Resell or redistribute the Service without authorization
• Use the Service for cryptocurrency mining

5. Content Ownership and Rights

5.1 Your Content

You retain all ownership rights to the content you upload. By uploading content, you grant us a limited license to store, transfer, and display your content solely for the purpose of providing the Service.

5.2 Your Responsibility

You are solely responsible for the content you upload and must ensure you have the right to upload and store such content.

5.3 Content Removal

We reserve the right to remove any content that violates these Terms or applicable law, without prior notice.

6. Service Tiers and Payments

6.1 Free Tier

The free tier provides limited storage (2GB) and file size limits (50MB). We reserve the right to modify free tier limitations.

6.2 Paid Subscriptions

Paid plans are billed monthly or annually. Payments are processed securely through Stripe. All fees are non-refundable except as required by law.

6.3 Cancellation

You may cancel your subscription at any time. Upon cancellation, you will retain access until the end of your billing period, after which your account will revert to the free tier.

7. API Usage

7.1 API Keys

API keys are provided for programmatic access to the Service. You are responsible for securing your API keys and all activity that occurs using them.

7.2 Rate Limits

API usage is subject to rate limits based on your subscription tier. Exceeding rate limits may result in temporary access restrictions.

7.3 Fair Use

API access is intended for legitimate application integration. Automated abuse or excessive requests may result in account suspension.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or experience outages. We are not liable for any loss or damage resulting from service interruptions.

9. Data and Backups

While we implement measures to protect your data, you are responsible for maintaining your own backups. We are not liable for data loss, corruption, or unauthorized access beyond our reasonable control.

10. Intellectual Property

The Service, including its design, features, and content (excluding user content), is owned by Mobcraft and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service.

11. Termination

11.1 By You

You may terminate your account at any time through your account settings. Upon termination, your data will be deleted in accordance with our Privacy Policy.

11.2 By Us

We may suspend or terminate your account for violation of these Terms, illegal activity, or extended inactivity. We will attempt to notify you before termination when practicable.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOBCRAFT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM.

14. Indemnification

You agree to indemnify and hold harmless Mobcraft and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, your content, or your violation of these Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Mobcraft operates, without regard to conflict of law principles.

16. Dispute Resolution

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
